When home building compensation cover applies
Most residential building work over $20,000 including GST requires HBC insurance unless exempt. Obtain the project certificate before paying any money, including a deposit, or work starts where required. These are regulatory conditions, not Panadium prices. Read the NSW Government insurance requirements for the actual proposal.
Do not assume that a small part of a larger scope can be assessed in isolation. Ask the contracting party to confirm whether the proposed work requires protection or an exemption applies, and keep the basis with the signed documents.
Eligibility is different from project cover
The icare HBCF homeowner fact sheet distinguishes a builder’s certificate of eligibility from the policy for a particular job. That document is a step before applying for project protection, not proof that your dwelling is insured.
Check the builder or tradesperson’s licence separately. A licensed builder, a completed-project photograph and an eligibility document answer different questions from the certificate identifying your proposed work.
Check the certificate of insurance
| Match | Check against |
|---|---|
| Contractor | The exact entity named in the building contract and relevant credential. |
| Property and scope | The address and description of the proposed work. |
| Certificate details | The document identifier and the official register. |
The icare fact sheet explains these matching checks. If details differ, ask the contractor and provider to resolve the discrepancy. Do not treat a document for another property as protection for your own.
Using the HBC check
The Service NSW project register lets you search using certificate details, the principal contractor or the insured property. Check the returned record against your documents and retain a copy. Verification is not an insurance application or acceptance of a claim.
HBCF and qualifying builder failure
The home building compensation fund is a safety net for qualifying failure. State Insurance Regulatory Authority (SIRA) guidance identifies insolvency, death, disappearance and certain licence suspensions tied to an unpaid order of the NSW Civil and Administrative Tribunal or a court. It is not ordinary protection for every disagreement with a business still operating.
Whether a loss is covered depends on the policy and circumstances. Ask the insurer promptly about incomplete or defective work and the conditions to make a claim. A defect concern also needs advice on the relevant warranty period. Do not assume a register result proves future claim acceptance or that waiting has no effect on your position.
Statutory warranties and project protection
| Protection | Question it addresses |
|---|---|
| Home building compensation | Is the project protected against qualifying contractor failure under the policy? |
| Legal and contractual obligations | What obligations apply to the work and its completion? |
| Public liability | What third-party liabilities does that separate policy address? |
Keep the protections distinct. A home warranty insurance label used in conversation does not replace reading the certificate and terms. This comparison is general owner guidance, not a personal policy assessment.
Questions a home owner should ask
Is the contractor’s eligibility the same as insurance for my project?
No. Obtain and verify the certificate for the actual property and work. Business-level credentials do not establish project-specific protection.
Does HBCF pay for every disagreement with a trading builder?
No. It is a safety net tied to qualifying failure and policy conditions, rather than ordinary first-instance dispute protection. Ask the provider about the circumstances of a potential claim.
Can I pay the deposit before receiving the required project certificate?
Current state guidance requires the certificate before any payment or work begins where protection is required. Verify that it matches the property, contractor and scope before proceeding.
Does this protection replace the contractor’s workmanship obligations?
No. Keep the project policy, legal and contractual protections and other insurance documents separate. One does not automatically replace the others.
The official obligations and certificate-checking service support these distinctions.
Plan the building work and documents
Keep the verified project certificate with the signed scope and correspondence. Discuss a proposed renovation through Panadium’s home project service and resolve documents before payment or commencement. The completion folder guide covers retaining records afterwards.
